The terms governing use of MyNightfall

These Terms of Service ("Terms") govern your use of MyNightfall's website and bedtime companion service (together, the "Service"). By creating an account or using the Service, you agree to these Terms.
MyNightfall offers reflective prompts and a calming bedtime experience. It is not a medical, mental-health, crisis, diagnostic, treatment, or emergency service, and it does not replace a qualified professional. Do not rely on the Service for medical advice, diagnosis, treatment, or emergency assistance. If you may harm yourself or someone else, or need urgent help, contact local emergency services or a qualified crisis or healthcare professional immediately.
You must be at least 16 years old and able to enter into a binding agreement where you live. You must provide accurate account information, keep your credentials confidential, and promptly notify us of suspected unauthorized use. You are responsible for activity under your account to the extent permitted by law.
You retain ownership of the information and material you submit to the Service ("Your Content"). You give us a limited, non-exclusive, worldwide, royalty-free license to host, process, reproduce, and display Your Content solely to operate, secure, support, and improve the Service. This license ends when Your Content is deleted, except where retention is required by law or reasonably necessary for security, dispute resolution, or backup cycles.
You confirm that you have the rights needed to submit Your Content and that it does not violate law or another person's rights. You must not submit illegal, infringing, threatening, abusive, exploitative, or harmful material.
You must not misuse the Service. In particular, you must not attempt unauthorized access; interfere with security or operation; use automated means to scrape or overload the Service; introduce malicious code; reverse engineer except where law cannot prohibit it; infringe intellectual-property or privacy rights; or use the Service in violation of law.
Some features require a paid subscription. Prices, billing interval, and any trial terms shown at checkout form part of your purchase. Paid subscriptions renew automatically at the selected interval unless you cancel before the renewal date. You can cancel through the billing controls provided to you; cancellation stops future renewals and does not ordinarily refund charges already paid, except where required by law or expressly stated at purchase. We may change future prices or plans with advance notice where required.
We and our licensors own the Service, including its software, design, branding, and other content, except Your Content. Subject to these Terms, we give you a personal, limited, revocable, non-transferable right to use the Service for its intended purpose. No other rights are granted.
We may change, suspend, or discontinue all or part of the Service. We may suspend or terminate access if we reasonably believe you violated these Terms, created risk or harm, or if required by law. You may stop using the Service at any time. Provisions that by their nature should survive termination will survive.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND UNINTERRUPTED OR ERROR-FREE AVAILABILITY. YOUR USE OF THE SERVICE IS AT YOUR OWN RISK.
TO THE FULLEST EXTENT PERMITTED BY LAW, MYNIGHTFALL AND ITS AFFILIATES, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES. OUR TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY, OR (B) US$100. Some jurisdictions do not allow certain exclusions or limits, so some of these limits may not apply to you.
To the extent permitted by law, you will defend, indemnify, and hold harmless MyNightfall and its affiliates, licensors, and service providers from claims, losses, liabilities, and expenses arising from Your Content, your misuse of the Service, or your violation of these Terms.
These Terms are governed by the laws that apply in the jurisdiction where MyNightfall is established, without regard to conflict-of-law rules. Mandatory consumer-protection laws of your place of residence remain unaffected. Before starting a formal dispute, contact support@mynightfall.com and allow us a reasonable opportunity to resolve the matter.
We may update these Terms. The effective date above shows when they were last revised. If changes are material, we will provide additional notice where required by law. Continued use after the revised Terms take effect means you accept them.

These Terms are provided in English and Chinese for convenience. If there is any inconsistency or difference in interpretation, the English version prevails.
